1. Agreement to Terms

By accessing our website or using our solar HVAC services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Services Description

Absolute FL HVAC Inc. provides:

• Solar HVAC system consultation and design
• Installation of Gree, Kinghome, and AAC solar HVAC systems
• System maintenance and repair services
• Energy efficiency assessments
• Warranty support and service

3. Quote and Pricing

All quotes provided are valid for 30 days unless otherwise specified. Prices are subject to change based on:

• Site assessment findings
• Equipment availability
• Permit requirements
• Additional work scope discovered during installation

Final pricing will be confirmed in a written contract before work begins.

4. Payment Terms

• Deposit: 25% due upon contract signing
• Progress payment: 50% due upon equipment delivery
• Final payment: 25% due upon system commissioning
• Accepted payment methods: Check, wire transfer, credit card, approved financing
• Late payments subject to 1.5% monthly interest

5. Installation and Service

Customer Responsibilities:

• Provide safe and clear access to installation areas
• Obtain necessary HOA approvals
• Ensure electrical system meets requirements
• Be available for system commissioning and training

Our Commitments:

• Professional installation by certified technicians
• Compliance with all local codes and regulations
• Obtaining necessary permits
• Clean and safe work environment
• System testing and commissioning

6. Warranties

Equipment Warranty:

Equipment warranties are provided by manufacturers (Gree, Kinghome, AAC) and vary by product. Typical coverage includes:

• Parts: 5-10 years depending on product
• Compressor: 7-10 years
• Solar panels: 25-year performance warranty

Installation Warranty:

We provide a 2-year warranty on installation workmanship. This covers defects in installation but does not include normal wear and tear or damage from external factors.

7. Limitation of Liability

Our liability is limited to the contract value. We are not responsible for:

• Indirect or consequential damages
• Lost profits or savings
• Damage from acts of nature or force majeure
• Damage from improper use or maintenance
• Pre-existing conditions not disclosed during assessment

8. Cancellation Policy

• Cancellation before equipment order: Full deposit refund
• Cancellation after equipment order: Deposit forfeited, customer responsible for restocking fees
• Cancellation after installation begins: Customer responsible for work completed and equipment costs

9. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Absolute FL HVAC Inc. or its licensors and is protected by copyright laws. System designs and proposals remain our property unless purchased.

10. Dispute Resolution

Any disputes will be resolved through binding arbitration in Miami-Dade County, Florida, in accordance with the American Arbitration Association rules. The prevailing party shall be entitled to reasonable attorney's fees.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

12. Energy Savings Disclaimer

Energy savings estimates are based on typical usage patterns and current utility rates. Actual savings may vary based on:

• Weather conditions
• System usage patterns
• Utility rate changes
• System maintenance
• Building modifications

We do not guarantee specific energy savings amounts.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of modified terms.
